1. 接受条款

下载、访问或使用碎语（VoiceBits，以下简称“本应用”），即表示你同意本服务条款和我们的隐私政策。如不同意，请勿使用本应用。若你未达到所在地区独立同意本条款所需的法定年龄，应由你的父母或法定监护人代表你同意。

2. 应用与使用许可

在你遵守本条款的前提下，我们授予你有限、非独占、不可转让、不可再许可、可撤销的许可，允许你在自己拥有或控制的兼容 Apple 设备上为个人或内部业务目的使用本应用。你还须遵守 Apple App Store 的适用使用规则。

你不得：

• 复制、出售、出租、分发本应用，或将其用于违法、欺诈或侵权活动；
• 在法律不允许的范围外，对本应用进行反向工程、反编译或试图提取源代码；
• 规避访问控制、订阅验证或安全措施；
• 干扰本应用正常运行，或侵犯他人权利。

3. 设备端功能与内容

本应用可在设备上录音、转写并整理你提供的内容。你保留对自己录音、文本、模板和导出内容的权利，并负责确保有权录制、处理和分享相关内容。录制他人或会议前，请遵守当地法律并在需要时取得同意。

自动转写、摘要、标题、标签、待办和其他设备端结果可能不完整或不准确。请在依赖或分享前核对，尤其不要将本应用输出作为医疗、法律、财务或其他专业意见。

4. 免费功能与碎语 Pro

本应用可提供免费功能和需要自动续订订阅的碎语 Pro 功能。Pro 的付费功能包括创建和使用自定义整理模板。当前权益、订阅周期及价格会在购买前显示于 App Store 的应用内购买页面，并可能因国家、地区、币种和 Apple 价格等级而异。

5. 1 个月免费试用

符合资格的新订阅用户可获得 1 个月免费试用，具体期限与资格以 Apple 购买确认页面为准。如未在试用结束前至少 24 小时取消，试用将转换为按月自动续订的付费订阅，并按购买页面显示的当地月价向你的 Apple ID 付款方式收费。你可以随时取消；取消在当前试用或订阅周期结束时生效。每个用户或订阅组通常仅可享受一次试用；Apple 可决定试用资格。

6. 付款、续订与取消

• 确认购买后，费用将从你的 Apple ID 账户扣取。
• 订阅会自动续订，除非在当前订阅周期结束前至少 24 小时关闭自动续订。
• 你可以在 iOS“设置”→ Apple ID →“订阅”中管理或取消订阅。
• 取消在当前已付费周期结束时生效；除法律或 Apple 政策另有要求外，已付费用不按比例退还。
• 退款请求由 Apple 按其政策处理。价格调整将按照 Apple 的规则通知并生效。

7. 本地数据与备份

应用内容主要保存在你的设备上。你应自行导出或备份重要内容。删除应用、删除本地内容、设备损坏或系统变化可能导致内容丢失；在法律允许的最大范围内，我们不对无法恢复的本地数据负责。

8. 可用性与变更

部分功能取决于兼容设备、iOS、Apple 的系统框架、语言或地区支持。我们可能为了安全、合规、性能或产品改进而更新、调整或停止功能。我们会在合理可行的情况下对重大变化提供说明，但不保证本应用始终不间断或无错误运行。

9. 知识产权

除你的内容外，本应用、网站、界面、名称、图形、软件及相关材料中的权利归我们或许可方所有，并受知识产权法律保护。本条款未授予你使用我们的商标、品牌或其他材料的权利，但正常使用本应用所必需的除外。

10. 免责声明

在适用法律允许的最大范围内，本应用按“现状”和“可用”基础提供，不作任何明示、默示或法定保证，包括适销性、特定用途适用性、不侵权、准确性或持续可用性的保证。部分地区不允许排除某些保证，因此部分排除可能不适用于你。

11. 责任限制

在适用法律允许的最大范围内，对于因使用或无法使用本应用引起的任何间接、附带、特殊、后果性或惩罚性损失，包括数据、利润或机会损失，我们不承担责任。我们的总责任不超过引起索赔前 12 个月内你为本应用支付的金额；若你未支付，则为适用法律允许的最低金额。法律不允许限制的责任不受本条限制。

12. 终止

你可随时停止使用并删除本应用。若你严重违反本条款，我们可在法律允许的范围内终止你的使用许可。终止不自动取消 Apple 订阅，你仍需在 Apple ID 设置中管理订阅。按其性质应继续有效的条款在终止后仍然有效。

13. Apple 特别条款

本条款由你与我们订立，而非与你和 Apple 订立。Apple 不负责本应用及其内容，也没有义务提供维护或支持。在适用法律要求的范围内，如本应用未满足适用保证，你可通知 Apple；Apple 的责任限于按其政策退还购买价款。Apple 及其子公司是本条款的第三方受益人，并可执行与其有关的条款。

14. 法律适用与消费者权利

本条款在不排除你居住地强制性消费者保护权利的前提下，适用开发者所在地法律。若适用法律赋予你不能通过合同放弃的权利，本条款不限制这些权利。争议应首先通过下方联系方式善意协商解决。

15. 条款更新与联系

我们可能更新本条款，并在本页面公布新版本与日期。继续使用更新后的应用即表示接受修订条款，但法律要求另行取得同意的除外。问题请联系 appxixiliu@outlook.com。

1. Acceptance

By downloading, accessing, or using VoiceBits (the “App,” also known as 碎语), you agree to these Terms of Service and our Privacy Policy. If you disagree, do not use the App. If you are not old enough to agree independently under local law, a parent or legal guardian must agree for you.

2. App License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for personal or internal business purposes on compatible Apple devices you own or control. Apple's applicable App Store usage rules also apply.

You may not copy, sell, rent, distribute, or use the App for unlawful, fraudulent, or infringing activity; reverse engineer or extract source code except where the law does not permit that restriction; bypass access, subscription, or security controls; interfere with normal operation; or violate another person's rights.

3. On-Device Features and Your Content

The App can record, transcribe, and organize content you provide on your device. You retain rights in your recordings, text, templates, and exports and are responsible for having permission to record, process, and share them. Follow local recording laws and obtain consent where required before recording other people or meetings.

Automated transcripts, summaries, titles, tags, tasks, and other on-device results may be incomplete or inaccurate. Review them before relying on or sharing them, and do not treat App output as medical, legal, financial, or other professional advice.

4. Free Features and VoiceBits Pro

The App may provide free features and VoiceBits Pro features through an auto-renewable subscription. Paid Pro functionality includes creating and using custom organization templates. Current benefits, billing period, and price appear on the in-App App Store purchase screen before you subscribe and may vary by country, region, currency, and Apple's price tiers.

5. One-Month Free Trial

Eligible new subscribers may receive a one-month free trial, with the exact duration and eligibility confirmed on Apple's purchase screen. Unless canceled at least 24 hours before the trial ends, it converts to a paid monthly auto-renewing subscription and charges the payment method linked to your Apple ID at the local monthly price displayed on the purchase screen. You may cancel at any time; cancellation takes effect at the end of the current trial or subscription period. A trial is generally available once per user or subscription group; Apple determines eligibility.

6. Payment, Renewal, and Cancellation

• Payment is charged to your Apple ID account when you confirm purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the current period ends.
• Manage or cancel in iOS Settings → Apple ID → Subscriptions.
• Cancellation takes effect at the end of the current paid period. Fees are not prorated except where required by law or Apple's policies.
• Apple handles refund requests under its policies. Price changes are communicated and applied under Apple's rules.

7. Local Data and Backups

App content is primarily stored on your device. You are responsible for exporting or backing up important material. Uninstalling the App, deleting local content, device failure, or system changes can result in loss. To the fullest extent permitted by law, we are not responsible for local data that cannot be recovered.

8. Availability and Changes

Some features depend on compatible hardware, iOS, Apple system frameworks, and language or regional support. We may update, change, or discontinue features for security, compliance, performance, or product improvement. We will provide reasonable notice of material changes when practicable, but do not guarantee uninterrupted or error-free operation.

9. Intellectual Property

Except for your content, the App, website, interface, names, graphics, software, and related materials are owned by us or our licensors and protected by intellectual-property law. These Terms do not grant rights to use our marks, branding, or materials except as necessary for normal use of the App.

10. Disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available,” without express, implied, or statutory warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or continued availability. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss arising from use or inability to use the App, including loss of data, profits, or opportunity. Our aggregate liability will not exceed what you paid for the App during the 12 months before the claim, or, if you paid nothing, the minimum amount permitted by applicable law. Liability that cannot legally be limited remains unaffected.

12. Termination

You may stop using and delete the App at any time. We may terminate your license where permitted by law if you materially breach these Terms. Termination does not automatically cancel an Apple subscription; you must still manage it through Apple ID settings. Provisions intended by their nature to survive will remain effective.

13. Apple-Specific Terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. If the App fails to conform to an applicable warranty, you may notify Apple where the law requires; Apple's responsibility is limited to refunding the purchase price under its policy. Apple and its subsidiaries are third-party beneficiaries and may enforce provisions relating to them.

14. Governing Law and Consumer Rights

These Terms are governed by the law where the developer is established, without excluding mandatory consumer protections in your place of residence. Nothing limits rights that applicable law does not allow you to waive. Please first contact us in good faith to try to resolve any dispute.

15. Updates and Contact

We may update these Terms and post the new version and date here. Continued use of an updated App indicates acceptance, except where separate consent is legally required. Questions can be sent to appxixiliu@outlook.com.
